Terms of Service

Last updated: October 3, 2026

These Terms of Service ("Terms") govern access to and use of the dental image conversion API and related tools available at dentalxrayconversion.com (the "Service"), operated by John Patrick Bender Jr., a sole proprietor ("Company," "we," "us"). By creating an account, purchasing access, or using the Service, you ("Customer," "you") agree to these Terms.

1. The Service

The Service converts Eaglesoft dental x-ray image formats into JPEG images through an API. Access requires an API key issued at signup. Eaglesoft is a trademark of its owner; the Company is not affiliated with, and the Service is not endorsed by, that company.

2. Accounts and API Keys

  • You're responsible for keeping your API key confidential and for all activity under it. If you believe a key has been compromised, you can rotate it yourself at any time (see the API docs) to immediately invalidate it and issue a new one. If you've lost every copy and can't authenticate a self-service rotation, contact us instead.
  • You must provide accurate information at signup and keep your billing details current with our payment processor.

3. Fees and Payment

  • The Service is billed per conversion, via Stripe as our payment processor. Current pricing is posted at /signup and /docs and may change.
  • Prices don't include sales tax. Where we're required to collect it, applicable tax is calculated at checkout from your location and added to your charges.
  • There is no minimum commitment. Billing is monthly, based on actual usage in that period.
  • We may, at our discretion, issue a free trial API key with a limited number of conversions and an expiry date. Trial conversions are not billed, and the key stops working when either limit is reached.
  • If a payment fails, we may suspend your account until it's resolved. You remain responsible for any fees already incurred.

4. Uploaded Images and Data Retention

Each uploaded image is processed in temporary storage for the sole purpose of producing your converted JPEG. If conversion succeeds, the original is deleted as soon as that's done, and the converted JPEG is returned in the API response and not kept.

If an image fails to convert, we may keep the original for up to 30 days, solely to diagnose and fix the failure. It's stored under its request ID rather than its original file name, in private storage covered by our cloud provider's Business Associate Agreement, and deleted automatically after that period.

Our Privacy Policy describes what other information we collect and how long we keep it.

5. Healthcare Data

Images processed through the Service may originate from dental practice management or imaging systems and may be associated with patient information (for example, in file names or embedded metadata). You represent that you have the right and any legally required authorization to submit such images for processing.

We sign Business Associate Agreements (BAAs) with customers who submit protected health information, but these Terms on their own are not a BAA. If you are a covered entity or business associate under HIPAA, you must have a signed BAA with us before submitting protected health information. To request one, contact support@dentalxrayconversion.com. Where a signed BAA is in place, it controls over these Terms with respect to protected health information.

You remain responsible for determining whether your use of the Service complies with your own obligations under HIPAA and any other applicable law.

6. Acceptable Use

You agree not to:

  • Attempt to circumvent rate limits, authentication, or other access controls;
  • Share, sell, or sublicense your API key to unrelated third parties;
  • Use the Service to process content you don't have the right to process, or for any unlawful purpose;
  • Attempt to reverse-engineer, decompile, or extract the underlying conversion technology from the Service.

We may suspend or terminate access for violations of this section, non-payment, or abuse of the Service.

7. Intellectual Property

We own the Service, including the underlying conversion software and technology. Nothing in these Terms transfers any of that to you. You retain ownership of the images you submit, subject to the limited license needed for us to provide the Service.

8. Service Availability; Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the maximum extent permitted by law. We don't guarantee uninterrupted or error-free operation.

9. Limitation of Liability

To the maximum extent permitted by law, Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Company's total liability for any claim relating to the Service will not exceed the fees you paid in the three (3) months preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold Company harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or content you submit without the necessary rights or authorization to do so.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the date at the top of this page. Continued use of the Service after a change constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.
